Terms of Use
1. Purpose
These terms of use (hereinafter "the Terms") set out the conditions governing access to and use of the Effinature platform (hereinafter "the Platform"), published by IRICE SAS. The Platform is a web application dedicated to the certification of biodiversity and ecological performance for construction, renovation and development projects.
Registration on and use of the Platform implies full and unreserved acceptance of these Terms.
2. Definitions
User: any natural person creating an account on the Platform, whether acting
as a certification applicant, a signatory, a Biodiversity Partner or any other participant.
Applicant: legal entity submitting a certification application via the Platform.
Biodiversity Partner: biodiversity expert qualified by IRICE, involved in
supporting certified projects.
Assessor: qualified person appointed by IRICE to conduct certification assessments
in accordance with the Effinature standards.
Certificate: document attesting to the conformity of a project with the requirements
of the applicable Effinature standard, issued by IRICE.
3. Access to the Platform
Access to the Platform requires the creation of a user account. Registration is free of charge. The user undertakes to provide accurate, complete and up-to-date information, and to keep it current throughout the period of use of the Platform.
The user is solely responsible for the confidentiality of their login credentials. Any use of their account is deemed to have been carried out by them. In the event of unauthorised use, the user must immediately notify IRICE at hello@irice-certification.com.
4. Services Provided
The Platform enables, in particular:
The submission and tracking of biodiversity certification applications under the NCO (New Construction), EVO (Existing & Renovation), HOR (Development) and HVE (High Ecological Value) standards; online signing of contractual documents (NDA, General Certification Conditions, certification contract); tracking of certification assessments (design, construction, CCR); consultation of assessment reports and certification decisions; document management for case files; consultation of the public directory of certified projects and qualified Biodiversity Partners.
5. User Obligations
The user undertakes to:
Use the Platform in accordance with its intended purpose and these Terms; not attempt to access the data of other users or unauthorised features; not use the Platform for unlawful, fraudulent purposes or in a manner that infringes the rights of third parties; not disseminate content contrary to public policy or good morals; maintain the confidentiality of information accessed in the course of certification procedures; not reproduce or use the Effinature standards, assessment grids or methodologies without the prior written authorisation of IRICE.
6. Certification Process
The Platform serves as the management tool for the certification process. The technical and contractual conditions of certification are governed by the General Certification Conditions (GCC) and the certification contract, which are documents separate from these Terms.
The issuance of an Effinature certificate is at the sole discretion of IRICE, based on assessments conducted in accordance with the applicable standards and internal procedures compliant with ISO 17065.
7. Intellectual Property
All elements comprising the Platform (architecture, design, source code, texts, logos, images, standards, assessment grids, reports) are the exclusive property of IRICE and are protected by intellectual property law.
The user is granted a personal, non-exclusive and non-transferable right to use the Platform, limited to the purposes set out in these Terms. Any unauthorised reproduction, extraction, reuse or exploitation is prohibited.
8. Personal Data
The processing of personal data is governed by the Privacy Policy, which constitutes a document separate from these Terms.
9. Platform Availability
IRICE endeavours to ensure the availability of the Platform 24 hours a day, 7 days a week. However, IRICE does not guarantee uninterrupted availability and reserves the right to temporarily suspend access for maintenance, updates or in the event of force majeure.
IRICE shall not be held liable for any damage resulting from temporary unavailability of the Platform.
10. Liability
The Platform is provided "as is". IRICE disclaims all liability in the event of: loss of data resulting from a technical failure; non-compliant use of the Platform by the user; fraudulent access to the user's account by a third party resulting from the user's lack of due care.
The liability of IRICE shall not exceed the amounts paid by the user under the current certification contract.
11. Termination
The user may request the deletion of their account at any time by sending a request to hello@irice-certification.com. Deletion will take effect within 30 days, subject to statutory and normative retention obligations (ISO 17065).
IRICE reserves the right to suspend or delete an account in the event of a breach of these Terms, following a formal notice that has remained without effect for 15 days.
12. Amendment of the Terms
IRICE reserves the right to amend these Terms at any time. Users will be notified of any changes via a notification on the Platform. Continued use of the Platform after notification constitutes acceptance of the amended Terms.
13. Governing Law and Jurisdiction
These Terms are governed by French law. In the event of a dispute relating to the interpretation or performance hereof, and after an attempt at amicable resolution, exclusive jurisdiction is vested in the courts having jurisdiction over the registered office of IRICE (Aix-en-Provence, France).
